General Terms and Conditions back
Your use of this Site and the Services is expressly conditioned on your
acceptance of the following terms and conditions. If you do not agree with any
part of the following terms and conditions, you must not use the Services or
browse this Site.
1. OWNERSHIP. This site (the "Site") is owned and operated by Rorke's
Drift Lodge ("RDL"). None of the content or data found in connection
with this site may be used, reproduced, sold, transferred, or modified without
the express written permission of RDL and/or its third party providers and
distributors. All material on this Site, including but not limited to images,
illustrations, audio clips and video clips, is protected by Copyrights. You may
not link directly to pictures, audio or video .ra, .rm or .ram files. You may not link directly to any scripts.
2. USE OF SITE. By accessing and browsing this site, you accept, without
limitation or qualification, that the author cannot accept
responsibility for any errors, omissions or subsequent alterations. If
you do not agree with any part of the terms and conditions, you must not use the
Services or browse this Site. You may only use the reservation services
("the Services") to make legitimate reservations and shall not use
this service to make any speculative, false or fraudulent reservation or any
reservation in anticipation of demand. By accessing and browsing the Site, you
accept, without limitation or qualification, the Terms and Conditions. Your use
and browsing of the Site is at your risk.
3. USE OF PHOTOS. None of the photos can be used, copied, reproduced, sold,
transferred, or modified without a written permission from RDL. You may not link
directly to any photo. Onward distribution
of photos to other users is not permitted.
4. AGE AND RESPONSIBILITY. You represent that you are of sufficient legal age to
use the Reservation Services and to create binding legal obligations for any
liability you may incur as a result of the use of our services. You understand
that you are financially responsible for all uses of this service by you and
those using your login information.
5. PRIVACY. Rest assured that RDL will not distribute specific information about
your reservations except to parties involved in your arrangements.
6. EXCLUSION OF WARRANTY. RDL does not warrant the accuracy, completeness,
merchantability or fitness for a particular purpose of any of the content or
data found on or in connection with this Site and Services. RDL is not
responsible for the contents of links and pointers to Internet sites maintained
by others.
7. LIMITATION OF LIABILITY. In no event shall RDL be liable for any injury,
loss, claim, damage, or any special, exemplary, punitive, incidental or
consequential damages of any kind (including, but not limited to lost profits or
lost savings), whether based in contract, tort or otherwise, which (i) arise out
of or are in any way connected with any use of this Service or content found
herein or in connection with the Service, (ii) any failure or delay (including,
but not limited to the use of or inability to use any component of this Service
or Site for reservations), or (iii) the performance or non
performance by third party providers or distributors, even if such party has
been advised of the possibility of such damages, or for any other party. If,
notwithstanding the foregoing, RDL or any third party provider or distributor
should be found liable for any loss or damage which arises out of or is in any
way connected with any of the above described functions or uses of this Site,
Services or its content, RDL, and third party provider's and distributor's
liability shall in no event exceed, in the aggregate, the service charge for
accessing this site with respect to which liability is found. In its sole
discretion, in addition to any other rights or remedies available to RDL, and
without any liability whatsoever, RDL at any time and without notice may
terminate or restrict your access to any component of this service. The
foregoing terms and conditions shall apply to both contract and negligence
claims.
8. INDEMNIFICATION. You shall defend and indemnify RDL and third party providers
and distributors from and against any claim or cause of action brought by or on
your behalf in excess of the liability described herein or by third parties as a
result of your use of the Services.
9. RELATIONSHIP. The relationship between RDL and you will be that of
independent contractors, and neither of us nor any of our respective officers,
agents or employees will be held or construed to be partners, joint ventures,
fiduciaries, employees or agents of the other.
10. SECURITY. We make every effort to ensure that your information
is protected while you are on
our site. However,
in the event of an unauthorized use, RDL is not liable.
11. GOVERNING LAW. The laws of Republic of South Africa shall govern this
Agreement and its performance.
12. ASSIGNMENT. You may not assign, convey, subcontract or delegate your rights,
duties or obligations hereunder.
13. RELATIONSHIP.The relationship between RDL and you will be that of independent contractors, and neither of us nor any of our respective officers, agents or employees will be held or construed to be partners, joint ventures, fiduciaries, employees or agents of the other.
14. CONTRACT. The booking is a binding contract between you and RDL.
Bookings are accepted via telephone, fax, email and all require 50 % deposit
within 15 working days of making the reservation. If the deposit is not
received within this time, provisional bookings will automatically lapse. Final
confirmation of a booking is only made on receipt of above-mentioned deposit and
the signed copy of the Terms and Conditions of Sale. Written confirmation will
be provided once the above terms have been met. No contract shall exist between
you and Rorke’s Drift Lodge until we have received your signed confirmation
and/or your deposit
15. GROUP BOOKING. Where a booking is made on behalf of several individuals the booking is conditional on the party leader having the authorisation of all the individuals named to enter into the contract. The party leader is responsible for both the deposit and the final balance payment.
16. PAYMENT. Full payment of the holiday cost must be made at least 8 weeks prior to your arrival.
17. CANCELLATION. If you wish to cancel your holiday after it has been confirmed, all cancellations must be confirmed in writing by the Party Leader. If you cancel your holiday, we reserve the right to charge a cancellation fee on the following scale:

No refund will be made for cancellation within 14 days of the scheduled arrival date. You are liable for the full amount of period booked, regardless of early check out or late arrival.
18. AMENDMENT. Rorke’s Drift Lodge will attempt to comply with all requests for amendments to bookings after the booking has been confirmed. If the changes you request cannot be made and you wish to cancel the holiday, cancellation charges will apply, effective from the date you requested the change. We accept no liability for anything if not confirmed in writing.
19. AMENDMENT. If you are prevented from proceeding with the holiday that you have booked, you may transfer the holiday to another person provided that you give us at least 28 days notice in writing with full details.
20. TRAVEL INSURANCE. We strongly advise you to take out travel insurance that includes protection against cancellation charges.
21. AMENDMENT BY RORKE'S DRIFT LODGE. If we have to make any changes to the holiday you have booked, we will advise you at the earliest possible date. If the change is of a major nature you will have the choice of either a) accepting the change of arrangements or b) cancelling your booking. Should you choose to cancel your holiday because of such a change, Rorke’s Drift Lodge must receive written notification to that effect within 14 days of the notification of the change. If you choose to cancel your holiday, we will refund you all money you have paid to us.
22. IMPORTANT. We will not be liable to pay compensation to you if we are forced to cancel or in any way change the arrangements for the holiday booked by you due to war, threat of war, civil disturbance, industrial dispute, terrorist activity, fire or adverse weather conditions, or any other reason outside our control, or if your enjoyment of your holiday is affected by such factors.
23. GOVERNANCE. The laws of Republic of South Africa shall govern this Agreement and its performance.
24. THE ACCESS ROAD The last 5 kilometers to our lodge is a farm track, and is constantly under construction. You may find it rough in places. To date 90% of the vehicles that have visited us have been standard passenger cars. All have arrived safely. However, it is our opinion that the track is not very kind to extremely low sporty, or overloaded cars. (Minimum clearance required for a vehicle is 15cm for the undercarriage). During the rainy season (from September - April ) we strongly recommend that guests consider hiring Nissan X-Trails or 4 x 4 vehicles for this leg of their journey. Cars can be interchanged along the journey. They are also great for visits to the Parks! Please contact us if you are not sure. Alternatively, last cell phone reception is at the gate. The track is particularly bad shortly after heavy rains. We do provide prearranged escort or ferry service if needed. (Cost R60 per trip) Secured (off site) parking can be arranged. 25. BEHAVIOUR. You undertake to behave in an orderly fashion and not to disrupt the enjoyment of others on holiday or in any way harm the reputation of Rorke’s Drift Lodge. The holiday of anyone in breach of this clause may be terminated forthwith and Rorke’s Drift Lodge shall have no further contractual obligations towards that person
26. COMPLAINTS. If you have a problem or a complaint, then you must bring it to our attention immediately so that we may have an opportunity to solve the problem locally.
27. DIETARY REQUIREMENTS. Rorke’s Drift Lodge requires notification of specific dietary requirements at least 7 days prior to arrival
28. MODIFICATION. RDL may at any time modify these terms and conditions and your
continued use of the Services will be conditioned upon the terms and conditions
in force at the time of your use. You are bound by any such modifications and
should therefore periodically visit this page to review the then current Terms
and Conditions to which you are bound.
29. ENTIRE AGREEMENT. These terms and conditions contain the entire agreement
between us relating to the subject matter hereof, and supersedes any prior
understandings or agreements (whether oral or written) regarding the subject
matter, and may not be amended or modified except in writing.
